Foreigners Who Will Work in Seasonal Tea and Hazelnut Agriculture Jobs
Foreigners who will work in tea and hazelnut agriculture jobs in our country can work by obtaining work permit exemption in accordance with the provision “Foreigners who will work in seasonal agriculture and animal husbandry works determined by the General Directorate are evaluated within the scope of work permit exemption for up to six months” in the subparagraph (g) of the first paragraph of Article 48 titled “Foreigners to be exempted from work permit” of the Implementing Regulation of the International Labour Force Law published in the Official Gazette dated 2/2/2022 and numbered 31738.
As a result of the evaluation made within the framework of the mentioned regulation; foreigners who will work in seasonal tea and hazelnut agriculture jobs in Artvin, Giresun, Ordu, Rize, Samsun and Trabzon provinces will be considered within the scope of work permit exemption for up to 6 months.
Foreigners who will work in seasonal tea and hazelnut agriculture jobs in the 6 provinces in question are required to apply for work permit exemption by submitting the necessary information and documents through our Ministry's e-Exemption system (https://emuafiyet.csgb.gov.tr).
a) Application address
Work permit exemption applications can be made online at https://emuafiyet.csgb.gov.tr.
If the foreigner is in Türkiye; if the foreigner has a foreigner identification number starting with 9 allocated to the foreigner, the foreigner can log in to the system via e-Government, if not, the foreigner can log in with the passport information.
If the foreigner is located outside of Türkiye, the foreigner must apply to the representative office of the Republic of Türkiye in the country where the foreigner is located and obtain a reference number. The foreigner can log in to the system from abroad using the reference number given to him/her.
b) Application Documents
During the application, the biometric photograph of the foreigner, valid passport or passport substitute document, Work Permit Exemption Request Form for Seasonal Agricultural Jobs and, if any, service contract and document related to the employer (Farmer Registration System Document) must be uploaded to the system.
c) Assessment Principles
While evaluating the work permit exemption application, the matters regarding whether the relevant foreigner is within the scope of work permit exemption, the work permit exemption periods determined in the relevant legislation and the control of the uploaded documents are taken into consideration. The application is finalized provided that the information and documents related to the application are complete and it is determined that foreigner is within the scope of the exemption. In case of need, the opinions of the relevant authorities may be received.
d) Work Permit Exemption Document
Foreigners whose applications are evaluated positively are issued a “Work Permit Exemption Document”. Payments for the work permit exemption must be paid by the person requesting the transaction subject to the fee.
If the period of work permit exemption is 3 months or more, the work permit exemption fee and valuable paper fee must be paid for the issuance of the document.
If the duration of the work permit exemption is shorter than 3 months, the work permit exemption fee is not paid. If the applicant requests the issuance of a document, it is sufficient to pay only the valuable paper fee. If the document is requested, the valuable paper fee will not be paid.
e) Work Permit Exemption Fee And Valuable Paper Fee Payment Methods
A notification regarding the payment transaction will be sent to the registered e-mail address of the foreigner whose work permit exemption application is evaluated positively. The amounts indicated in the email must be paid within 30 days at the latest. Otherwise, the aplication will be rejected. Payments can be made directly from the Digital Tax Office (dijital.gib.gov.tr) of the Revenue Administration by credit card, or they can be made through contracted banks in Türkiye.
