Conditions And Process For Foreigners To Open a Company / Workplace In Türkiye
Article 5, paragraph (l) of the Regulation on Business Opening and Work Licenses published in the Official Gazette dated 10.08.2005 and numbered 25902 stipulates that "The provisions of the legislation on foreigners shall be complied with regarding the opening and operation of workplaces by foreign nationals" and in accordance with Law No. 6735, foreigners who will open a workplace must obtain a work permit from our Ministry before starting to work.
In case foreigners wish to open a workplace and work on their own behalf and accounts, they are required to apply to our Ministry for a work permit following the completion of the establishment procedures of such workplaces before the relevant authorities (such as publishing the workplace in the trade registry or chamber of tradesmen registry newspaper and obtaining a tax number).
As a result of the evaluation to be made by our Ministry, foreigners whose request is approved and granted a work permit are obliged to apply to the relevant municipalities with these permits and request a workplace opening and work license.
Issuance of workplace opening and work licenses; The Ministry also grants temporary work permits to foreigners who are business owners or partners, and it is possible for the relevant municipalities to issue workplace opening and work licenses to these foreigners, taking into account the periods specified in the temporary work permit document. Our municipalities do not need to request an Independent Work Permit Certificate from foreigners with a temporary work permit in this context.
The procedures and principles regarding the ability of Syrians under temporary protection to work in our country are regulated by the "Regulation on Work Permits for Foreigners under Temporary Protection" published in the Official Gazette dated 15.01.2015 and numbered 29594, and foreigners under this scope must obtain a work permit from our Ministry in order to work in our country.
Foreigners who work independently on their own behalf and account within the scope of temporary protection must obtain a work permit before starting to work by scanning the documents showing the activity of the workplace such as the trade registry gazette for companies, the relevant chamber registration certificate for real person merchants and tradesmen and craftsmen into the automation system during the application, after the establishment procedures of the workplace are completed, provided that they have tax numbers. Authorized administrations will require the foreigner to have a work permit when issuing a workplace opening and work license.
