Foreigners Under International Protection
INTERNATIONAL PROTECTION TYPES
1- Refugee
Refers to the status granted after status determination procedures to a foreigner who, as a result of events occurring in European countries, is outside his/her country of nationality and is unable or, owing to such fear, unwilling to avail himself/herself of the protection of that country because of a well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion, or to a stateless person who, as a result of such events, is outside his/her country of former habitual residence and is unable or, owing to such fear, unwilling to return to it.
The refugee status holder may work as a dependent or independent person from the date of obtaining the status. Provisions in other legislation regarding the jobs and professions that foreigners cannot work are reserved.
Since the identity document issued by the Presidency of Migration Management to the foreigner with refugee status will replace the work permit; People who have gained these statuses can work in our country with the identity document in question.
2- Conditional Refugee
Refers to a foreigner who, as a result of events occurring outside European countries, is outside his/her country of nationality and is unable or, owing to such fear, unwilling to avail himself/herself of the protection of that country because of a well-founded fear of being persecuted for reasons of race, religion, nationality, membership of a particular social group or political opinion, or to a stateless person who, as a result of such events, is outside his/her country of former habitual residence and is unable or, owing to such fear, unwilling to return to it. A conditional refugee is allowed to stay in Türkiye until he/she is resettled in a third country.
Türkiye accepted the 1951 Geneva Convention with "Geographical Restriction" by using the right to choose in terms of location in Article 1. Accordingly, conditional refugee; He/she is a person who requests international protection from Türkiye to seek asylum in third countries, claiming that he/she meets the conditions in the refugee definition due to events occurring outside Europe.
For foreigners who have received conditional refugee status, a work permit application can be done after six months after the international protection application date. If the application is approved, a work permit is given to the foreigner in question.
3- Secondary Protection
It refers to those who do not meet the requirements to be refugees or conditional refugees, but when they are returned to their country of origin or country of residence;
Will be sentenced to death penalty or will be executed,
Be subjected to torture, inhuman or degrading punishment or treatment,
Will face serious threats to his/her person due to indiscriminate acts of violence in situations of international or domestic armed conflict,
Secondary protection status given after the status determination procedures to a foreigner or stateless person who cannot benefit from the protection of his/her country of origin or residence due to his/her status or who does not want to benefit from the protection of his/her country of origin or residence due to the threat in question.
The status granted to a foreigner or stateless person who is unable or unwilling to benefit from the protection of his/her country of origin or country of residence due to the threat thereof, after status determination procedures.

4- International Protection Applicants
For foreigners applyed for international protection, a work permit application can be done after six months after the international protection application date. If the application is approved, the foreigners in question are given a work permit.
